Dear Robert,
I think it is clear that Jerome Kerviel did not defraud the French bank because he was not trying to take the bank's money. He only breached internal bank rules about the amount he could trade -- and was so successful that, in order to hide things, he had to start making a loss.....! An amazing case.
He is probably guilty of falsifying records but not fraud. .
