QuestioN:  Is Guantanamo Bay U.S.- Operated Prison A
U.S. Constitution Free Zone?

Answer:  In the 2004 Hamden case the Supreme Court,
inter=alia ruled that Guantanamo is not a U.C.
Constitution-free zone.  It is doubtful the Court will
overrule this decision in favor of the Bush regime
argument that the writ of Habeas Corpus is not
available to aliens or foreigners on the battlefield
"outside" the U.S. Consider whether Guantanamo is a
"battlefield".   Note that under the Cuba-U.S. Treaty
and lease, osetensibly, Cuba retains sovereinty over
the prison.  At issue is what constitutes territorial
jurisdiction of a"foreign" U.S. military base.  Is
such a base akin to the territorial jurisdiction of
U.S. over a foreign embassy?

    The exceptions to suspension of the Writ in the
Constitution are for insurrection or rebellion.  The
Congressional statutory exceptions to application of
the Writ to Guantanamo prisoners are legally not an
equivalent substitute to  the remedies of the actual
Writ.

    Thoughts of other legal scholars is invited
regarding this most important issue.
